Abstract

The item of “intruding into individual’s dwelling house without any proper reason” was important in Chinese legal history since the Tang Code. On the legal academic history, Xue Yunsheng and Shen Jiaben in the late Qing Dynasty combined the origin and development of the item in the history perspective. In the second half of the 20th century, Dai Yanhui, Liu Junwen, Gui Qixun, Yan Xiaojun and Zhongcun Zhengren researched the item in the criminal law perspective, especially legal defense. It is unwise to disregard the relationship between the item and the housing right system. Although the item is perished and different from the housing right system in the west legal system, it is still meaningful in the contemporary China. Maybe we can learn from the item and other related legal tradition to solve some old problems such as forced eviction.
