On Land Transaction Law of the Southern Song Dynasty-The Land Transaction Cases in the Ming-gong Shu-pan Qing-ming Ji
Abstract
Land transaction, was a consistent issue in traditional China. The land transaction law of the Song dynasty was relatively characteristic. As special legal systems, the existence of Dian (approximately equivalent to mortgage), priority of relatives, priority of the one who had graveyard of his ancestor, and so on, restrained the transactions of land, but at the same time it made the transactions happened in a way which people can accepted at that time. The land transaction law of the Southern Song dynasty reflected the changes of the society. Furthermore, it promoted the changes of society. We should attach importance to the experiences and lessons in it.
