摘要
程樹德在整理中國古代法制資料方面，扮演著承先啟後的關鍵，唯後人對程氏的認識，大多止於《九朝律考》一書。有鑑於此，本文討論的重點有三：（一）程樹德的生平與著作、（二）從《漢律摭遺》與《漢律考》看程樹德對律的輯佚與體例編排、（三）程樹德的法史觀。以程氏的著作切入，一方面檢視《歷代刑法考‧漢律摭遺》與《九朝律考‧漢律考》，比較沈家本與程氏對律的輯佚，以及體例編排認知上的相異處；另一方面從程氏的法史學論著中，歸納其法史觀的特點，重新賦予其在法制人物中所應有的地位。
Cheng Shu De, who reorganized China ancient legal material, acted the key which inherited from the past and carried on for the future, only the posterity to Cheng understanding, mostly stopped in “Jiu Chao Lü Kao”. Based on this, this article discussed about three points: (one) the biography and the writings about Cheng Shu De, (two) from “Han Lü Zhi Yi” and “Han Lü Kao” observated that Cheng Shu De edits losing law and style arrangement, (three) law history viewpoints about Cheng Shu De.Cuts into from Cheng writings, on the one hand inspected that “Li Dai Xing Fa Kao Han Lü Zhi Yi” and “Jiu Chao Lü Kao‧Han Lü Kao”, compared with cognition in difference that Shen Jia Ben, and Cheng edit losing law and style arrangement;on the other hand from representing ancient law history writings of Cheng, then induced its law history characteristics, entrusted with proper status in the legal history character.
