摘要

近代中國的法律改革，董康乃有典範意義的人物之一。本文從傳記法學的角度，回顧其法律人生，評介其法學著述，並以董康前後期法律思想的轉折為著眼點，通過對其著述的梳理，勾畫出一位法學家於近代中國這一特殊的時空中內心的曲折變化，並試圖予以解釋，進而反思近代以降法律繼受的問題。

With respect to the modern China’s legal reform, Dong Kang is a characteristic and significant figure. Here we will review his legal dedication and works. Based on the analysis of the transition of his legal thoughts and of his books, this paper is intended to draw the outline of this outstanding lawyer with a special historical background, and to interpret and introspect the issues involved with the legal reception movement in modern China.
