摘要

本文嘗試在此分析目前在中央研究院所收藏北京中國第一歷史檔案館中，有關大清帝國刑科所藏刑部及三法司題本複份的命案類「婚姻姦情專題微捲檔案」，希望透過分析這份檔案，探討未來這些檔案可能將如何影響中國法制史的研究，作者在文章中嘗試分析「婚姻姦情專題微捲檔案」中「依強姦未成但經調戲本婦羞忿自盡例」的案件類型，希望透過這種案件類型的內容分析，進而初步討論如何可能運用這份檔案，重新建構清朝的法律體制的真實現象，作者同時希望透過對於這份檔案的分析，瞭解在清朝法律體系下生活的人民與當時的性別關係，尤其希望透過檔案瞭解清朝婦女在法律上的處境。

 

 

The present paper analyzes the cases in “the Microfilm of Marital Adultery files” collected from Qing-dynasty Legal Case Records of Grand Secretariat, held by Academia Sinica in Taiwan.  The article discusses how these files will influence future studies of Chinese legal history. The present paper focuses on the cases involving shamed women committing suicide after experiencing attempted rape or sexual harassment. Through the careful study on these cases, the present paper: reconstructs the legal system in Qing-dynasty by using case records, and represents life and gender relations in terms of the legal system, finally, "re-portrays" women's positions from the perspective of law in Qing-dynasty.
