摘要

近代以來，諸多研究中國歷史的學者認為，中國或沒有宗教，或最淡於宗教。具體到中國法律史的研究，一些學者也認為，中國傳統法的特徵之一是它的世俗性。例如，瞿同祖先生在其著作《中國法律與中國社會》中用一整章討論「巫術與宗教」。在他筆下，至少在國家制定法層面，宗教與法律早劃清界限；中國傳統法律「不曾依賴巫術宗教的力量來維持」，「在中國法律制裁與宗教制裁或儀式制裁是分開的」。與瞿同祖先生上述觀點大致相符的經典著作，還有美國學者德克‧布迪（Derk Bodde）等人的《中華帝國的法律》。該書在對比了幾個文明古國的法律起源觀念之後，明確主張「在中國，最初促使法律產生和發展的，既不是宗教因素，也不是經濟因素」。現代學者中，如張中秋先生比較中西法律文化時亦認為，二者的重要差異之一即是西方法律文化的宗教性與中國法律文化的倫理性；換言之，濃厚的神權法時代（指夏商周時期）之後，中國傳統法律便一直朝著倫理化（儒家化）方向發展，甚至在集大成的唐代之後仍在「深化和擴散」；但無論如何，與「宗教」無關。
