近代憲政視野中的晚清彈劾軍機案 The Impeachment of the Privy Council in the Late Qing Dynasty from a Modern Constitutional Point of View

摘要

本文通過較深入的資料發掘，考證了曾經轟動一時後又被人遺忘的晚清彈劾軍機案，並將其置於整個近代中國憲政追求進程中，來分析該案的前因後果進而評判其價值，指出：晚清彈劾軍機案的發生和草草收場，與中國長期以來所存在的皇權專斷為特徵的權力運作有必然聯繫；在軍機案中，立憲原則已成為國家意識形態和權力運作的重要組成部分。這是近代中國憲政的一個亮點，也是近代中國立憲經驗累積的第一步。
 

The thesis made a textual research on the case of Impeach Privy Council in the Qing Dynasty by abundant material , analyzed cause and effect of the nine day’s wonder case, made a conclusion: the case ended hastily had an inevitable relation with China’s arbitrary imperial power. Constitutional principles had already been a crucial part of ideology and authority operate. The case was very important in modern China’s constitutional government.
