摘要
韓非是中國戰國時代法家集大成的法學家。中國法系是世界五大法系之一。中國法系中，最重要的兩種法律思想就是儒家法律思想與法家法律思想，直到二十一世紀的現在為止，雖然研討韓非思想、韓非法律思想，論者繁多，蔚為大觀，但卻還沒有學者以其法律思想的基礎理論，作為課題進行全面的、比較的探討。因此，我準備先解明韓非法律思想的基礎理論，即其人性觀、歷史觀、方法論，並比較與其相關的現代西方法學理論，從而顯出韓非法律思想在現代法學理論上的意義。
Han Fei was the most great legal thinker of Legalists in the Warring States Period. The Chinese legal family has been one of five big legal families in the world. Among the Chinese legal family the most important two legal thoughts are Confucianism and Legalism. Until 21 century now, although there have been abundant essays about Han Fei's thought or his legal thought, but we couldn't find out an essay , which focusing Han Fei' s philosophical bases of his legal thought, and searching its significance in the modern legal theory. So I would like to explore into the basic theories of his legal thought firstly, and then compare them with the modern west legal philosophy. Such I think I could make the meaning of Han Fei 's legal thought in the modern legal theory more clear and more enlightening.
